Anti-Spam Policy
This Anti-Spam Policy applies to kamal.ai, operated by Data Mahi Limited (NZCN 8381624) trading as Kamal (we, us or our), and to everyone who promotes us.
1. Our position
kamal.ai has a zero-tolerance policy toward spam. We do not send unsolicited commercial messages, and we do not authorise, permit, or condone anyone else sending unsolicited messages that advertise, reference, or link to kamal.ai or any of our services, products, domains, or content.
This policy applies to us, our employees and contractors, our affiliates and referral partners, our resellers, our marketing agencies, and any other person or entity acting on our behalf or promoting us for compensation of any kind.
2. What we mean by "unsolicited message"
For the purposes of this policy, an unsolicited message is any commercial or promotional message sent to a recipient who has not given prior, express, and verifiable consent to receive it — or who does not otherwise fall within a narrow, lawful exception in their jurisdiction.
This includes, without limitation:
email (including bulk, transactional-disguised, and one-to-one cold email);
SMS, MMS, RCS, and other mobile messaging;
WhatsApp, Telegram, Signal, iMessage, and similar messaging platforms;
direct messages, connection requests with promotional payloads, and unsolicited replies or mentions on social platforms (X, LinkedIn, Instagram, Discord, Slack communities, Reddit, and others);
comment spam, forum spam, guestbook spam, wiki spam, trackback and pingback spam, and automated blog commenting;
newsgroup, Usenet, and mailing-list postings outside a group's stated charter or rules;
automated voice calls, robocalls, ringless voicemail, and voicemail drops;
faxes; and
any messaging channel or protocol developed in future that serves a functionally equivalent purpose.
3. Prohibited conduct
No person may do any of the following in connection with promoting kamal.ai:
Consent and list sourcing
Send any message to a recipient without prior express consent from that recipient.
Use purchased, rented, borrowed, traded, scraped, or harvested contact lists.
Use address-harvesting software, directory-harvest attacks, or dictionary attacks to generate recipient addresses.
Import contacts from a third party's list, CRM, or database without confirming that valid consent was obtained for our messages specifically.
Continue messaging a recipient after they have unsubscribed, opted out, replied "STOP", marked a message as spam, or otherwise indicated they no longer wish to be contacted.
Message integrity
Falsify, forge, or obscure header information, sender names, return paths, reply-to addresses, or originating IP addresses.
Use deceptive, misleading, or irrelevant subject lines.
Fail to clearly identify the message as a commercial communication.
Omit a functioning, free, and easily accessible unsubscribe mechanism, or fail to honour opt-out requests promptly.
Omit an accurate physical postal address for the sender where the applicable law requires one.
Infrastructure
Relay messages through third-party mail servers, open relays, open proxies, or compromised systems without permission.
Use throwaway domains, redirect chains, link shorteners, or cloaked URLs to conceal that a message advertises kamal.ai.
Register domains, subdomains, or accounts using false identifying information for the purpose of sending promotional messages.
Operate bot networks or automated accounts to distribute promotional content at scale in violation of a platform's terms of service.
Indirect promotion
Engage any third party, agency, or contractor to do anything listed above.
Promote kamal.ai in any message that itself violates this policy, even if the message primarily advertises something else.
4. What lawful marketing looks like
Where we or our partners send commercial messages, we require that:
consent was obtained through a clear, affirmative, opt-in action — not a pre-ticked box, not an inference from a purchase, and not bundled into unrelated terms;
a record of that consent is retained, including the date, time, source, and method by which it was given, and can be produced on request;
the sender is clearly and accurately identified;
every message contains a working one-click unsubscribe or equivalent opt-out;
opt-out requests are actioned within the shorter of the legally required period or five (5) business days, across all sender systems and lists;
suppression lists are maintained permanently and checked before every send; and
the content of the message matches what the recipient consented to receive.
5. Affiliates, partners, and resellers
Participation in any kamal.ai affiliate, referral, reseller, or partner programme is conditional on full compliance with this policy.
If we determine, in our sole and reasonable discretion, that a participant has breached this policy, we may take any or all of the following steps without notice:
immediately terminate the participant's account and programme membership;
void and forfeit all unpaid commissions, credits, bonuses, and referral fees;
reverse or claw back previously paid commissions attributable to the breach;
recover from the participant any costs, fines, penalties, damages, blacklisting-remediation expenses, or legal fees we incur as a result;
suspend or terminate any kamal.ai service accounts held by the participant;
report the conduct to relevant platforms, hosting providers, mail providers, anti-abuse organisations, and regulatory or law-enforcement authorities; and
cooperate fully with any resulting investigation or proceeding.
Our decision as to whether conduct constitutes a breach is final. Ignorance of this policy, reliance on a subcontractor, or a claim that a list was "opt-in" without supporting consent records is not a defence.
6. Legal framework
This policy is designed to meet or exceed the requirements of applicable electronic-messaging laws in the jurisdictions where we and our partners operate, including but not limited to:
New Zealand — Unsolicited Electronic Messages Act 2007;
Australia — Spam Act 2003;
United States — CAN-SPAM Act of 2003; Telephone Consumer Protection Act (TCPA);
Canada — Canada's Anti-Spam Legislation (CASL);
European Union — GDPR and the ePrivacy Directive (2002/58/EC) as implemented in member states; and
United Kingdom — UK GDPR and the Privacy and Electronic Communications Regulations 2003 (PECR).
Where this policy and applicable law differ, the stricter standard applies. Senders are responsible for compliance in every jurisdiction in which their recipients are located.
7. Reporting a violation
If you have received an unsolicited message advertising kamal.ai, we want to know. Please report it to abuse@kamal.ai.
To help us investigate, please include where possible:
the full message, including all headers (for email, use "show original" or "view source" rather than forwarding);
the date and time you received it;
the sending address, phone number, or account handle;
any links, tracking codes, or affiliate identifiers contained in the message; and
the address or number at which you received it.
We acknowledge reports and investigate every one. Where we identify a responsible affiliate or partner, we act under clause 5. We will not share your contact details with the sender.
If you believe your address was added to one of our own lists in error, contact us at the address above and we will remove it and confirm the removal.
8. Impersonation and spoofing
kamal.ai is not responsible for messages sent by third parties who spoof our name, domain, or branding without authorisation and who have no commercial relationship with us. We nonetheless investigate such reports and pursue takedowns, domain suspensions, and legal remedies where practicable. Reports of impersonation should be sent to the address in clause 7.
9. Changes to this policy
We may update this policy from time to time. The current version is always available at https://kamal.ai/anti-spam. Material changes take effect on the date published. Continued participation in any kamal.ai programme after that date constitutes acceptance of the revised policy.
